The following covenants apply to all lots within the Villa Dieppe Subdivision, Unit 21, and forms part of this deed and to its successors. For the purpose of clarity, in this document, The Developer, being DM Développements Developments Ltée/Ltd, means the same as the Vendor;
1 ) All homes shall be residential single unit, and shall be built on site. No prefab or premanufactured homes allowed.
2 ) There shall be no live stock on the property, such as, but not limited to, poultry, pigs, etc;
3 ) Gardens shall be erected in the backyard. Except for flower gardens, it is strictly prohibited to have gardens in the side and front yards.
4 ) Vehicles, Recreational Vehicles, utility trailers, shall be parked in driveway only and not on grass. All parked vehicles shall be in good operational condition and shall have all wheels on at all times. There shall be no vehicle maintenance and bodywork done except inside the garage, only if municipal by-laws allow this type of activity. Garage door must be closed during any repairs or maintenance done on any vehicles, and such vehicles must be registered to house owner(s);
5 ) There shall be only one residential structure on lot with an attached garage. Single car garage shall have a minimum of 16 feet wide, and a double car garage shall have a minimum of 21 feet wide. All garages shall be equipped with garage doors;
6 ) The owner(s) of the lot shall have their building plans approved in writing by a representative of the Developer, being DM Développements Developments Ltée/Ltd prior to start construction. Plans shall include lot layout and front elevation and any other information which would be requested by the Developer. Exterior finish colors shall also be approved by the Developer.
7 ) All driveways and garages shall be located on the right side of the house. For clarity, the right side is when standing on the street looking toward house.
8 ) There shall be no sheds, baby barns, pool accessory structures, or any other types of free standing structures erected on lot. No detached garage is permitted.
9 ) Clothes lines are prohibited;
10 ) Grass shall be mowed on a regular basis and at no time be more than 6 inches in height.
11 ) Exterior of house shall be totally completed within 12 months from the date the construction started. At that time, there shall be no construction debris on site. This includes house to be fully covered by acceptable siding material. There shall be no unpainted exterior siding or fence.
12 ) Landscaping, including grass/lawn, shall be completed no later than 18 months from the date the house construction started. Driveway shall be paved with either asphalt pavement, concrete, or pavers, no later than 24 months after the start of house construction;
13 ) Following are the minimum requirements for house structures to be erected on lots:
a ) A one level house shall have a minimum of 1,200 square feet of living
ground floor. This is excluding basement, attic and garage square
footage;
b ) A two level house shall have a minimum of 850 square feet of living
area per floor. This is excluding basement, attic and garage square
footage;
c ) the total width of the house, including garage, shall have a minimum
of 50 feet;
d ) 30 % of the house façade shall be finished with stone, brick or
stucco. Other material can be accepted upon written consent from
the developer.
14 ) The Purchaser shall receive a written permission from the Developer for any application to have the municipal Zoning By-Law modified that would affect the lot or its use;
15 ) Any cost encounter to have the owner(s) remedy any of these covenants that would be ignored or contravened, will be the responsibility of such owner(s);
